Welcome to Gifts’N’Giggles! Please read our terms carefully before purchasing.
By placing an order through our website, social media accounts, or direct messaging, you agree to the following Terms & Conditions.
1. GENERAL INFORMATION
1.1 Handmade Nature
All products are handcrafted and made-to-order. Slight variations in color, design, or arrangement are normal and not considered defects.
1.2 Availability
Materials, flowers, and packaging may vary based on season and supplier stock. If we cannot complete your order, you will receive a full refund.
1.3 Service Area
We offer local pickup, delivery within Ottawa, and shipping to select Canadian cities.
1.4 Currency
All prices listed on our website or communicated directly are in CAD, unless otherwise stated.
2. ORDERING PROCESS
2.1 Website Ordering (Preferred)
Customers are encouraged to use our website to order or request custom quotes.
2.2 Ordering via Instagram DM or Email
If ordering through DM, please include:
- Item requested
- Theme or colors
- Budget
- Date needed
- City + delivery method
2.3 Booking Deadlines
- Orders must be placed at least 7 days in advance.
- Rush orders may be accepted (subject to availability) and may include a rush fee.
3. PAYMENTS & DEPOSITS
3.1 Deposit Requirement
A 50% non-refundable deposit is required to secure your order.
3.2 Final Balance
The remaining balance must be paid at least 24 hours before pickup, delivery, or shipping.
3.3 Payment Methods
We accept the payment options listed on our website (e-transfer, debit/credit, etc.).
3.4 Non-Payment
If the final payment is not received by the deadline, your order may be canceled without refund of deposit.
3.5 Fraud & Chargebacks
Gifts’N’Giggles reserves the right to dispute any fraudulent chargeback claims with supporting evidence (messages, photos, delivery proof, receipts, etc.).
4. CANCELLATIONS, CHANGES & REFUNDS
4.1 Cancellations
- Orders cannot be cancelled once production has started.
- Deposits are non-refundable unless Gifts’N’Giggles cancels your order.
4.2 Order Changes
- Small changes (ex: color tweaks) must be requested within 24 hours of booking.
- Major changes may affect pricing and availability.
4.3 Refunds – General
Refunds will not be issued for:
- Change of mind
- Personal preference issues
- Minor imperfections that do not affect functionality
- Variations in handmade products
- Delays caused by couriers, weather, traffic, or incorrect address
5. MONEY BOUQUET POLICY
(Special section for cash-based items)
5.1 Damage or Loss During Transit
If a money bouquet arrives significantly damaged or is confirmed lost in transit, customers may be eligible for a refund of:
- 50% of the cash amount only (not including design, service, or delivery fees).
5.2 Eligibility Requirements
To qualify for compensation, you must:
- Report the issue within 24 hours of delivery
- Provide clear photos/videos of the bouquet and packaging
- Contact us via email or Instagram DM
5.3 Exclusions
- Minor dents, creases, or aesthetic imperfections are not eligible for refunds.
- Multipurpose bills (folded for design) may show natural bends. This is normal.
6. DELIVERY, PICKUP & SHIPPING
6.1 Address Accuracy
Customers are responsible for providing accurate delivery information. We are not liable for delays or losses due to incorrect or incomplete addresses.
6.2 Delivery Terms
- Delivery windows are estimates and may vary.
- Once the item is handed to the courier, recipient, or postal service, Gifts’N’Giggles is not responsible for delays, damage, or loss.
6.3 Local Pickup
- Customers must arrive at the scheduled time.
- Missed pickups may incur a rescheduling fee.
6.4 Shipping Methods
- For security reasons, we do not publicly disclose shipping companies or methods.
- Tracking (if applicable) is provided once shipped.
7. CUSTOMIZATION & CREATIVE DISCRETION
By placing a custom order, you authorize Gifts’N’Giggles to:
- Select appropriate materials within your chosen theme
- Make design adjustments based on availability, safety, or quality
- Deliver a product that aligns with your inspiration but is not an exact replica
Variations do not constitute grounds for refund.
8. PHOTOS, CONTENT & COPYRIGHT
8.1 Marketing Use
We may photograph or film your order for advertising, unless you request privacy at the time of booking.
8.2 Intellectual Property
All images, videos, logos, text, and designs on our website or social media remain the property of Gifts’N’Giggles. Unauthorized use, copying, or reselling of our designs is prohibited.
9. SAFETY & ALLERGIES
- Customers are responsible for checking for allergies (latex balloons, flowers, fragrances, etc.).
- Gifts’N’Giggles is not liable for allergic reactions or improper handling after pickup/delivery.
10. CUSTOMER RESPONSIBILITY
By ordering, you agree to:
- Handle items with care
- Provide accurate information
- Be available for pickup/delivery
- Read product descriptions thoroughly
- Understand the handmade nature of items
11. LIABILITY DISCLAIMER
Gifts n Giggles is not responsible for:
- Delays caused by weather, traffic, or couriers
- Damage after delivery or pickup
- Lost, misplaced, or stolen items after handoff
- Improper storage conditions (heat, moisture, etc.)
To the maximum extent permitted by law, our liability shall not exceed the amount paid for the product in question.
12. DISPUTE RESOLUTION
In the event of a disagreement:
- Customers must contact us directly first
- We will work in good faith to resolve the issue
- Unresolved matters will be governed by laws in the province of Ontario, Canada
13. BUSINESS HOURS
- Mon–Fri: 10AM–6PM
- Sat: 11AM–3PM
- Closed Sundays & holidays
Please allow up to 24–48 hours for responses during peak seasons.
14. UPDATES TO TERMS
We may update these policies at any time. The most current version will always be posted on our website.
15. AGREEMENT
By placing an order with Gifts’N’Giggles, you confirm that you have read, understood, and agreed to all policies listed above.
